Terms of Use

These Terms of Use ("Terms") govern your use of the mobile games and websites operated by Elmwood Nexus LLC ("we", "us", "our"), including PLAYCALLER: Roguelike Football (each, "the Game", and together, "the Games"). By downloading, installing, or using the Games, you agree to these Terms. If you do not agree, do not use the Games.
1. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Games on a device you own or control, for your own non-commercial entertainment. You may not copy, modify, reverse engineer, decompile, resell, rent, or redistribute the Games or any part of them, except where that restriction is prohibited by law.
All content in the Games, including code, artwork, audio, and the Elmwood Nexus and Playcaller names and logos, remains our property or that of our licensors.
2. Eligibility
The Games are not directed to children under 13, and you may not use the Games if you are under 13. If you are between 13 and the age of majority where you live, you may use the Games only with the involvement of a parent or guardian who agrees to these Terms.
3. Accounts and Anonymous Identifiers
The Games create an anonymous identifier automatically so scores and progress can be saved. No email address or personal login is required. You are responsible for activity that occurs under your identifier on your device. Uninstalling a Game may permanently disassociate you from your identifier, display name, and leaderboard history, and we cannot restore them.
4. Leaderboards, Display Names, and Conduct
Setting a display name is optional. If you set one, it is public and visible to other players.
You agree not to:
Choose a display name that is obscene, hateful, harassing, sexually explicit, threatening, defamatory, or that impersonates another person or entity
Include contact information, web addresses, or advertising in a display name
Use automated tools, modified clients, memory editors, network interception, or any other method to submit scores that were not achieved through ordinary gameplay
Attempt to gain unauthorized access to our servers, interfere with the Games, or disrupt other players' use of them
Reverse engineer or attempt to derive any credentials, keys, or protocols used by the Games
We may, at our sole discretion and without notice, remove or reset any display name, remove or refuse any leaderboard entry, suspend or terminate access to leaderboards or the Games, and retain records associated with an identifier for enforcement purposes. We are not obligated to explain enforcement decisions and there is no guarantee of leaderboard placement or continuity.
5. Reporting Objectionable Content
The Games include a way to report a display name you believe violates these Terms. We review reports and act on them, typically within 24 hours. Reported players are hidden from your view of the leaderboard immediately. You may also report content by contacting us at hello@elmwoodnexus.com.
6. User Content
By submitting a display name or other content through the Games, you grant us a worldwide, royalty-free, non-exclusive license to store, display, and distribute that content in connection with operating the Games, including on public leaderboards. You represent that you have the right to submit it.
7. Advertising
The Games are supported by advertising served by third parties, including Google AdMob. Advertisements are not endorsements. We are not responsible for the content of advertisements or for anything you obtain from an advertiser. Handling of advertising data is described in our Privacy Policy.
8. Availability and Changes
The Games and their online features, including leaderboards, are provided on an as-available basis. We may modify, suspend, or discontinue any Game or feature, in whole or in part, at any time and without liability to you. Leaderboard data may be reset, corrected, or removed, including to address cheating or abuse.
9. Disclaimer of Warranties
THE GAMES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAMES WILL BE UNINTERRUPTED, SECURE, OR ERROR FREE, OR THAT DATA WILL BE PRESERVED.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELMWOOD NEXUS LLC AND ITS MEMBERS, OFFICERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR GAME PROGRESS, ARISING OUT OF OR RELATING TO YOUR USE OF THE GAMES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE GAMES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR TWENTY FIVE UNITED STATES DOLLARS.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Elmwood Nexus LLC from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising from your misuse of the Games, your violation of these Terms, or your violation of any law or third party right.
12. Termination
We may suspend or terminate your access to the Games or their online features at any time, with or without cause and with or without notice. You may stop using the Games at any time by uninstalling them. Sections 6 and 9 through 14 survive termination.
13. Apple and Google
These Terms are between you and Elmwood Nexus LLC only, and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the Games or their content, and have no obligation to provide maintenance or support. Apple Inc. and Google LLC are third party beneficiaries of these Terms and may enforce them against you. Your use of the Games must also comply with the applicable app store terms of service.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict of law rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Wisconsin for any dispute not subject to small claims court.
15. Changes to These Terms
We may update these Terms from time to time, with or without notice. Changes will be reflected in the Effective Date above, and your continued use of the Games after changes take effect means you accept them.
